Dispute Resolution

The UK has the most comprehensive anti-bribery legislation in the world by virtue of the Bribery Act 2010.

We represent the interests of individuals and companies in investigations conducted by the Serious Fraud Office (SFO), The Financial Conduct Authority (FCA) and the Financial Reporting Council (FRC). Our advice should be sought at the earliest possibility or at the outset of any investigation or at the earliest possibility.

Bribery Act 2010

Bribery and corruption laws have seen substantial change over the past decade. The implementation of the Bribery Act 2010 created new criminal offences: as well as prohibiting the giving and receiving of bribes in the public and private sectors; the legislation creates corporate criminal liability in the form of the ‘failure to prevent offence’ which penalises commercial entities for failing to prevent bribery unless they can show they had adequate preventative procedures in place.

Internal Investigations

Considering the change in law, it is common practice now for companies to regularly investigate themselves and self-report to the regulators. Our lawyers have experience in conducting and overseeing such investigations. Our extensive experience and robust approach allows us to identify, assess and advise upon all civil, criminal or regulatory issues that may come about during the course an internal investigation. Where breaches are identified we can advise on whether a report should be made to the relevant enforcement agency as well as the timing and content of any report.
